In a shocking development, noted TV and film actress Ekta Kapoor and her mother Shobha Kapoor have been booked under the Protection of Children From Sexual Offenses (POCSO) Act. The charges stemmed from a complaint that a website developed by their company, ALT Balaji, targeted minors and contained objectionable content. This development created a buzz within the entertainment industry, with many voicing concerns about the increasing scrutiny of digital platforms in India.
The Allegations
According to reports, The complaint is based around season 6 of Gandii Baat, which aired on Ekta Kapoor’s OTT platform ALT Balaji between February and April 2021. It contained explicit and objectionable content in certain places in violation of the POCSO Code Complaint said the series featured inappropriate images of children.
The web series in question, features sensitive themes and bold plots, causing concern among some viewers. ALT Balaji has created several shows that push the envelope in terms of representations of sexuality, relationships and taboos However, they have succeeded, and have also generated controversy over how it depicts important issues.
Legal Action and Response
Based on the complaint, a First Information Report (FIR) was registered against both Ekta Kapoor and her mother, Shobha Kapoor, under various sections of the POCSO Act, along with charges under the Information Technology (IT) Act for disseminating obscene material online. The POCSO Act, which was enacted in 2012, is a stringent law aimed at safeguarding children from sexual offenses, exploitation, and pornography.
The police have launched an investigation into the matter, and both Ekta and Shobha Kapoor are expected to respond to the summons for questioning. Legal experts have noted that these are serious charges, and if found guilty, the consequences could be severe.
Digital content laws in India
The case reignited the debate on censorship and content regulation in India’s digital space where fast-growing OTT platforms like ALTBalaji, Netflix and Amazon Prime have largely operated without the strict censorship that governs television and movies , giving the filmmakers more freedom to explore unconventional themes but with this freedom comes a heightened sense of exploration.
Pressuring the Indian government to enforce stricter regulations for OTT platforms, especially in response to complaints of pornography, religious insensitivity and indecent content, several cases have been filed against filmmakers and a they already make films on subjects deemed offensive.
